Terms
The agreement, in plain words.
Last updated
These terms are between RelaTax (“we”), which operates Shule Yangu, and the school that signs up to use it. Staff and parents use the service under the school’s account, and the parts about accounts and conduct apply to them too. Signing in is agreeing to them.
1. What the service is
Shule Yangu is software for running a Kenyan primary or junior school on the Competency-Based Curriculum: learner and staff records, CBC assessment and report cards, fee notes, receipts and payment tracking, messages to parents, and a portal where a parent sees their own child. It is provided over the internet, and as an app a parent can install on a phone.
It is a tool for the school’s own decisions, not a substitute for them. A fee note is what the school chose to charge; a report card is what the school’s teachers recorded. We do not verify either.
2. The school’s account
- The school names an administrator, who creates and removes staff and parent access and decides what each person may see and do.
- The school is responsible for keeping its accounts to the people they were issued to, and for deactivating anyone who leaves. What is done under an account is the school’s doing until we are told otherwise.
- Each person keeps their own password or PIN private. Sharing a sign-in is a breach of these terms.
- The school confirms it is entitled to enter the records it enters — that it has the authority, as the learner’s school, to hold them and to share them with the learner’s guardians.
3. The school’s data
The school’s records belong to the school. We hold them on the school’s behalf, on the terms in the privacy policy, which forms part of this agreement. We may use anonymised, aggregated information — how many schools, how many learners, which features are used — to run and improve the service. We do not use a school’s data to train models, to advertise, or for any purpose of our own.
On request at any time, and always when the agreement ends, we return the school’s records in an ordinary, readable form.
4. Money
- Fees for the service are agreed with each school in writing before it starts, and invoiced by RelaTax. If a fee changes, the school is told at least one term in advance.
- School fees paid by parents never pass through us. They go to the school’s own bank account or M-Pesa paybill. Shule Yangu records them and matches them to the right child; it does not hold, move or guarantee them.
- Where a school turns on M-Pesa payment prompts, those run on the school’s own Safaricom credentials and are subject to Safaricom’s terms.
5. What we undertake
- To keep the service available, apart from maintenance we announce and faults we fix as fast as we can. We aim for the service to be up whenever a school is open, and we tell schools when it is not.
- To keep the school’s data separate from every other school’s, protected as described in the privacy policy, and backed up weekly.
- To tell the school without undue delay, and within 72 hours, if we become aware that its data has been accessed by someone who should not have.
- To support the school: a named contact, and an answer to a question within one working day.
6. What we ask
- Use the service for running the school, and nothing that is unlawful, harmful, or that interferes with other schools’ use of it.
- Do not attempt to reach another school’s data, to probe or overload the service, or to reverse-engineer it.
- Send parents only what the school is entitled to send them, and stop when they ask. Messaging that a parent has opted out of, or that is not about the school, is a breach of these terms.
- Keep the school’s own details — bank account, paybill, contacts — accurate, because they are printed on every fee note and receipt.
7. Limits
We are not liable for a decision the school makes on the basis of a record it, or its staff, entered; for money that a parent paid to the wrong account or with the wrong reference; for the acts of Safaricom, Meta, Google or a telecoms carrier; or for loss caused by the school’s own breach of these terms. Nothing here limits liability that cannot be limited by Kenyan law. Beyond that, our total liability to a school in any year is limited to the fees that school paid us in that year.
8. Ending it
- The school may stop at any time by telling us in writing. We return its records and delete our copies as described in the privacy policy.
- We may suspend an account that is being used in breach of section 6, and will say why. We may end the agreement with a school on one term’s notice, or immediately for a serious breach that is not put right within fourteen days of our asking.
- If we ever stop operating Shule Yangu, every school gets at least one term’s notice and its records back.
9. The rest
- These terms are governed by the laws of Kenya, and any dispute goes to the courts of Kenya. We would rather it went to a conversation first.
- If we change these terms, the date at the top moves and the school is told before the change takes effect. Continuing to use the service after that is accepting the change.
- If any part of these terms turns out to be unenforceable, the rest still stands.
- This page and the privacy policy are the whole agreement, together with the written fee agreement for each school.
